All comments received during the comment period have been taken into consideration in finalizing the Manual. The overall structure, number of chapters and subject matter covered in the Manual has not changed. The following is a summary of the key comments received on this proposal and how these were addressed.
Best Management Practices
Commenters indicated that new best management practices (BMPs) should be identified in the Manual. They suggested, for example, that providing a well record is a best management practice for shallow works that is not adequately clarified in the Manual. It was also suggested that other best management practices be clarified, including additional courses for well technicians beyond minimum requirements and on topics directly related to their work.
Consideration of these comments has led to a decision to create new BMPs. The following are examples of new BMPs. The Manual includes best management practices for completing and submitting a well record for shallow works, as well as for taking additional courses to help ensure continued knowledge of environmental requirements and technological advances.. A list of titles of new BMPs created in response to stakeholder comments can be obtained by contacting the contact person listed in this notice.
Changes to the Wells Regulation
Several comments related to Ontario Regulation 903 and suggested changes.
As the proposal posting was not intended to seek comments related to how to improve the regulation, these comments did not result in updates to the Manual. The Ministry will continue to consider these comments on Reg. 903.
The Manual is designed to explain the minimum requirements of the regulation to increase understanding of the requirements. The Manual also provides best management practices for test holes and dewatering wells.
Technical Corrections/Changes to the Manual
A number of comments requested clarification of terms, correction of technical information and addition of other technical information. For example, it was requested that “basal subsoil” be further defined. Additionally, commenters suggested that technical information on proprietary technologies was omitted.
The Manual has been updated to include clarification on a number of terms in Chapter 2. Some of the technical content of the Manual was revised to enhance clarity. For example, basal subsoil was further defined and additional information was provided on proprietary technologies.
