Description of Regulation:

The Government of Ontario aims to protect pollinators by addressing the four main stressors that pollinators face: pesticide exposure; loss of habitat and nutrition; climate change and weather; disease, pests and genetics.

A comprehensive Pollinator Health Action Plan would improve the state of pollinator health in Ontario and strengthen their populations. The plan we are proposing to develop will promote a sustainable food supply, healthy ecosystems and a strong economy.

As a first step, the Province is proposing a change in the pesticides regulation to address the impact that pesticide exposure is having on pollinator health.

The draft regulatory amendments are intended to reduce the number of acres planted with neonicotinoid insecticide treated corn and soybean seeds by 80 percent by 2017. The amendments to Ontario Regulation 63/09, under the Pesticides Act would establish:

  • a new class of pesticides consisting of corn and soybean seeds treated with the neonicotinoids, imidacloprid, clothianidin or thiamethoxam
  • rules for the sale and use of treated seeds
  • timing and implementation of the regulatory requirements.

If approved, new rules on the sale and use of corn and soybean seeds treated with the neonicotinoids, imidacloprid, clothianidin or thiamethoxam will be in place by July 1, 2015, in time for the 2016 agricultural planting season.

Purpose of Regulation:

The purpose of these regulatory amendments is to reduce the use of corn and soybean seeds treated with imidacloprid, clothianidin or thiamethoxam in Ontario.

This proposal was posted for a 45 day public review and comment period starting March 23, 2015. Comments were to be received by May 07, 2015.

All comments received during the comment period are being considered as part of the decision-making process by the Ministry.

A Regulation Proposal Notice (EBR Registry Number 012-3068 – Pollinator Health: A Proposal for Enhancing Pollinator Health and Reducing the Use of Neonicotinoid Pesticides in Ontario) was posted by the Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) for a 61-day public review and comment period starting November 25, 2014 and ending January 25, 2015.

As a result of the public consultation on the proposal, OMAFRA received a total of 1,543 comments on the Environmental Registry and 50,686 emails through the pollinatorhealth@ontario.ca email account associated with the proposal. All comments received during the comment period are being considered as part of the decision-making process by the Ministry of Agriculture, Food and Rural Affairs and the Ministry of the Environment and Climate Change (MOECC).

Additionally, OMAFRA and MOECC held 9 consultation and engagement sessions with a broad range of parties including agriculture, agri-business, pesticides, beekeeping, environment, health, and academia.
